Hi Lecky Les 

I contacted the president to ask for up to date information on the administrator of the community and he responded to say he is the president and the administrator.

what do I do now, I did not know this and it explains why my emails have not been answered

Carrie, that is, at least, some progress.

Why not ask him why there has been no AGM and no Annual Accouting statements sent out . Then ask him for a copy of these Statements covering all the years you have not recieved them.

Next you could ask him what legal steps he is taking in regards to recovering the fees owed by the Non Paying residents.

He has a Legal obligation to give you all the above mentioned information.

I cannot thank you enough, on reflection I guess I have just been accepting the situation but due to the difficulty in negotiating 3 flights of stairs I now feel at the end of my tether and nee answers and a way forward. 

I have contacted the president and apparently now the administrator to ask for copies of the AGM and statements since 2007 so hopefully that will help

Carrie, having Arthritus and therefore, mobility issues ,together with living on an upper floor with a non functioning lift is a situation that needs addressing, Hopefully, contact with your President / Administrator will now lead to improvements .

Hello Carrie, 

Your President andadminidtrstor should be taking this forward. We also have debtors in our community and as a community we are taking the debtors including the builder to Court. This is done through the administrators and the President. The situation should be discussed at the AGM and the minutes should reflect this. If you are not hearing anything from administrators and no AGM being held then I suggest you contact your President to ask what is happening and if no joy say you want them to hold an extrodinary meeting. If unsatisfied you can put yourself forward for election as president and you can also raise changing administrators if the current ones are not doing a good enough job.

It is the President's legal responsibility to keep the community solvent.   He should be taking to court those not paying the community charge.

The electronic pool access system is good, as a former President I have used that tactic, but of course it has no effect, if like me you don't use the pool !!  At the end of the day it is the President who has to take action, not the administrators.

Hi Carrie,

If your president is also the administrator, that would mean that he is in sole control of the bank account. As you are paying your fees you have a right to see what those fees are being spent on. I would demand to see the accounts and bank statement. Please post on here the answers you get. Don’t feel bad about asking, it is your right.
