Smoke Free Zone

Good Morning
We live in San Luis is it a smoke free zone our neighbour is continually using cheap wood and black smoke is pouring out of his chimney into our living room and newly painted house.
They painted their house 2 weeks ago and already his chimney stack is black it appears to be rather mild today yet they have it on .We cannot go out of out kitchen without instantly coughing .We have tried to reason with them. It is the only one in the area to be black .
