Hi, is it possible for my partner to get her residency off the back of mine ? I am on a state pension so have the S1, we have been together for 2 years and she has her social security number, padron and nie number.

Hi I'm afraid your partner will not be allowed on to tag onto  your residency, as in Spain you have to be married.

What is a partner?

The term has no defined meaning in law and can range from someone you met on a plane coming over to someone you've spent decades living with!

I'll have to leave it to others to flesh out the details however I'm sure you will have to demonstrate some sort of medium or long term relationship and/or dependency in order for a 3rd party to benefit on the back of your residency.

In your case that might be as simple as the willingness of DWP to issue her an S1 based on your entitlement, certainly that's what it will take for her to qualify for state health care.

Perhaps you’re partner should look into private health insurance,

I also was not entitled to a S1.....

You definitely have to be retirement age on state pension (I think)

It's also going to be difficult to prove your together for 2 years.

You were doing so well until the (I think)!

Yes ignoring the fact that some exportable benefits can be qualifiers for a S1 it's the drawing of the State Pension which is the watershed event.

Since every case for unmarried couples will be different the only way to get a conclusive answer is to phone DWP.

Under the new rules, the amended financial requirements section has introduced the possibility for one of a 'pareja de hecho' to apply as a family member of the other partner. 

That means formally registering your partnership.

That entitlement is only for complying with the financial requirements. Your partner would still need to provide proof of health cover, either by having paid social security payments or private health insurance.

Thanks Jim, she has a sip card but unfortunately lost her job last week due to the virus . She worked in a restaurant but now there isn’t enough work, she had a contract too.
