How can I collect a Tax Certificate in person?

Hoping someone can kindly help us out here.

We used a reputable Tax Accountant in Orihuela Costa, following a recommendation, for our first tax return this year.

He knew it was our first time and that we were totally in his hands. We supplied him with all the information and documentation in time for our return to be submitted. 

We were told to call him in September to pick up our Tax Certificates from him, which we desperately need to claim pax tax that has been double paid to HMRC.

After a number of emails and visits, we finally received notification from him that they had rejected it as they needed more documents - 12m stamped statements from our Spanish Bank, utility bills,etc. The bank were very surprised - though still charged us €72 between our 2 accounts! Also, the address the Tax Office had for us was incorrect.

Now, we are being told that we have to pay the accountant another €50 for him to supply the additional information. He is saying the Tax Office are sending the Certificates directly to us, but we have a sneaky feeling he is withholding the additional information from them until we pay the ransom money.

Does anyone know how we can query this directly with the Tax Office to check if they have the certificates and if we can collect them in person please?

We feel as though we are being taken for a ride! Although I speak a little Spanish, I am fearful of dealing with any official offices, so would appreciate any advice and information before I embark on this venture please. Many thanks

Hi, 

It doesn't help with your predicament but as I am sure you already know, everything official takes time and rarely is completed first time round. 

From my understanding you cannot have any direct contact with the tax office (person to person) it is always through correspondence or email. I am sorry to say but If this is the case then it is going to be very difficult for you to do anything else but swallow the charges and continue on the route you are on. 

Getting the final tax acceptance is really important and although you feel aggrieved at the extra charges it is probably worth it in the grand scheme.

Hi Jill,

I seem to remember that my application was also rejected first time and they asked for more bank statements. At the time my accountant had to take the documents to the inland town of Orihuela, so it took 3 trips in all, the final one to pick the certificate up. However when they applied for my husband’s it was all done online, and the certificate came in the post. Although the tax people give a list of required documents, you will find that they often want more. Obviously extra costs can occur for the extra work. Just say, ‘well it only has to be done once’ and whilst I think your accountant is doing ok, it doesn’t hurt to chase them up. Then you will have a further wait to get a refund with HMRC. Everything comes to those who wait, ha ha. Good luck and stay positive.😀

Hi Jill,

When you appointed your Tax Accountant, did you (or he) complete a Modelo 030, the form required to register you with the Agencia Tributaria (tax office)?  You would both have needed to sign it, so hopefully he would have given you a copy?

If you prefer to check out the status of your Tax Certificates in person, rather than relying on your Accountant, you can visit an Agencia Tributaria office, but you need to make an appointment online first (take a copy of the Modelo 030 with you):

Thank you everyone for your help. We will definitely need to follow up on the Modelo 030 - we’re not aware of this form and have not been given a copy.

After my initial post on the Forum, I decided to politely challenge the Accountant ... and miraculously, the certificates arrived in yesterday’s mail ! 

Still not sure if there are any shenanigans going on, but I think we’ll be going to a different accountant next year, as I don’t have much faith in him, now. We’ve seen  number of recommendations on this Forum .. including ours!
