I think the 90 day rule is nothing new and applies to all EU and non EU citizens. Do a search on here, I have seen it mentioned several times.

If you want to live in Spain permanently you need to apply for residency within the first 90 days.
The 90 in 180 rule has always been but never enforced.

As you are Irish and Ireland is a member of the EU ,you can legally stay in Spain for 180 days

On residency if you are going to spend more than 182 days in a calender year you should start your application for residency after being in Spain 90 days.
In truth as you have freedom of movement once you enter the Schengen are no one knows where you are so you can travel in Europe as long as you want. I think it is legal to spend under 90 days in Spain, then the same in Portugal and back to Spain and onto France and back to Spain, and this is why people with UK Passports have been able to be resident in UK but actually live in Spain, not paying into the Spanish system.

Actually, Eileen is wrong, you cannot stay LEGALLY in Spain for 180 days. It's a legal requirement for EU citizens to comply with Spanish residency law and register their presence here if they intend to stay longer than 90 days.
However, in practice (and this also applied to UK citizens when we were in the EU), Spain doesn't bother enforcing it's own residency laws with EU citizens, so long as you don't exceed 182 days in Spain - if you do, you become tax resident in Spain by default.
Whether the Spanish will continue to be so lax when ETIAS is introduced next year is anybody's guess 😉

Yes Kim,you are quite right in what you say . Sorry about the confusion . Technically you are supposed to register for residency after 90 days but it is not enforced so you can stay for the longer period without a problem
