Thank you.from what i have read on line the tax goes back 4 years with interest and the fine will probaly make up for the rest ,but i will no more tomorrow.

Hi Stirling36,

I agree with PeterPan.  You do not need to waste money on a lawyer who will tell you what you've already been told - the Spanish tax office (Agencia Tributaria) can go back up to 4 years to claim the annual back taxes, plus fines for late payments.  Engage a gestor to submit your Non Resident Tax (Modelo 210) for this year - I also recommend Spanish Tax Forms:

This can all be done via email and if you're not in Spain, they can make the tax payment on your behalf for a small extra charge.  If you are currently in Spain, the other gestor I would recommend is Uma Sanz at Get Legal in Spain:

Your first submission this year may well trigger a claim from the tax office for back taxes and fines, but please don't worry, you're certainly not the first non-resident to be unaware of this requirement, but you don't need to pay a lawyer's hourly rate to do something that a competent gestor is perfectly capable of doing at a much lower fee.

We saw a Spanish lawyer about our non-resident tax and were advised that as we completed 16th December 2019, that we needn't bother making a submission for 2020. Last year, we approached the same lawyer, and they seemed slow completing the documentation, so we went to Sun Lawyers (fiscal department). They were brilliant. It turned out we should have made a submission during 2020, so Sun Lawyers did this on our behalf. We were required to pay 20 euros tax plus interest. Sun Lawyers now make our submission annually and the process is easy. I would imagine you will be required to pay the amount of back-tax, plus interest that the tax office is allowed to request from you. I imagine, being proactive now and straightening out this situation will end positively for you

It happened to me when I lived in tenerife.same rules mainland spain.I did not pay for 12 years and a friend put me onto a jester.no need for a layer.The jester told me to pay 4years and that was the end of that

Thanks Sue, that's almost double the amount Spanish Tax Forms Ltd. charge at £34.95 per property (not per person) plus £12 to pay the tax on behalf of the owner.  Also, I believe a Spanish gestor would be cheaper than a lawyer too.
