Is it not about the difference between residency and citizenship? If you had obtained citizenship of Spain you would have freedom of movement in Schengen as an EU citizen, but that is not conferred by residency alone, which only entitles you to stay in Spain for more than 90 days. Step outside an...

...d you become a 3rd national with your UK passport - although it seems unlikely you will get checked if you just move around Schengen.

Exactly, if I drive to France then onto Germany who would know?

I think someone has already mentioned this. Unfortunately passports will be stamped or swiped on entry and exit of a country thereby tracking you stay within the EU.

But ... Surely this defeats the whole idea of Shengen  that being that you could move between member states without border controls ?  I think you would only be stamped on entry and exit to the Shengen area thus starting or stopping your 90 day clock

You are right. The point I was trying to make, but failed, was you don't get 90 days in France, 90 days in Spain etc.

If I drive from Spain to France there are no checks, the same applies between France and Germany, whether hotels are obliged to inform the Police of our arrival is another matter but I doubt that would happen, I've no idea what happens if you get the train between Schengen countries as I haven't travelled by train across Europe while Schengen has been in operation. There's no way that those of us with TIEs allowing us to live in Spain will be denied entry into other EU countries once our 90 days are used up where we live.

I'm still confused I have a British passport and travel ( when permitting) between Spain and the UK to visit and stay with family no longer than 2 weeks in any 12 month period.

My question is when I leave Spain my passport will be stamped on exit and again when I return, so what happens when I want to return to the UK in say 4 or 5 months from my return to Spain my passport stamps will show me as overstaying when in fact I have residency in Spain.

...

There will be no trouble entering the UK on a UK passport and on your return to Spain you will probably have to show proof of residency.
