Selling our house without an agent
Hi has anyone on this forum sold a property without using agents. I know well need a lawyer n Notary etc but is there anything else l need to do

Hi. It's quite straightforward. I have been involved ( over 20yrs) with friends who have bought houses privately ( by word-of-mouth &/or local knowledge). One's own abogado is the important part. The simple answer is, without a 3rd party ( eg: estate agent, ) both the vendor & buyer avoids agent's commission. A good solicitor essential. V

Hi Gill,
Yes I have, 4 times. I think that if you and the buyer have a language in common it could work for you. If you don't have a high level of Spanish then I would be wary.
You could always get a translator if necessary.
I actually haven't used lawyers but I have lived and worked in Spain for decades and I am a translator.

Yes I have 5 times and never used a lawyer you do not need one it is the buyer who does. Make sure they get a bank cheque, use a notary who speaks good English so you know what's going on. I have actually bought 6 times without a lawyer simple because the first time we did it the laywer didn't point out a lot of things that they should have. They only check water, electricity, community fees to see if they are paid you can do that yourself it is easy. As to the deed you can check that too if there is anything that needs updating get the sellers to do it. The notary will stop the sale if he comes across anything that is not as it should be, then it must be put right or parties agree it's ok.

When you have a buyer and you have both agreed on a move date then book a notery, they will give you a list of documents you need to have. Pay the water etc up to date and arrange to change the name and bank account with your buyers on the day to theirs. If they want to register the property on the land register they can ask the notary to prepare the papers and then take them to the office, it usually costs more than it actually is when they go to pick up the document they will probably get a refund. If there is any "extra" tax to be paid then this can be paid over one to two years if they go and ask at the office. the same applies to you if you are buying. You don't say where you are or I am not looking :) but I have used these Notaría de José Carlos Pérez Juan based in Almoradi even when selling out of area because he is extremely good both at his job and his language, also will give help and advice on documents (we had a hold-up with a fiscal paper once and the paper work was s t r e t c h ed until we could file) saving us money it did not effect our sale.
