Inheriting Property

Hi All, my husband and I have a property in Denia, we are non resident ( we live mostly in the UK ), it was purchased in my husbands name and he has a NIE - I do NOT have an NIE.

He has a Spanish will that leaves the property to me if he dies ( lets hope he doesn't just yet ), but lets say the worse happens and I inherit the property as per the will.

Can I inherit it without having an NIE ?

Hi,

It would be advisable to get an NIE number now, if not, one would need to be obtained by you if you are the survivor.

If you predecease him, then the reserve beneficiaries within his Will need to obtain NIE numbers at that time and, potentially each provide a Power of Attorney to an abogado for them to arrange probate and distribute the estate according to the instructions within the Spanish Will (assuming the reserve beneficiaries do not speak sufficiently proficient Spanish to undertake that process themselves). This can of course, depending on the fees of the specific abogado, be an expensive process.

This process of probate will also be required to be undertaken on the first and second deaths btw.

As the previous poster has suggested it is advisable to have a NIE as in the event of a death you will more than likely have some interaction with the Spanish authorities who will ask for your NIE.
